Gli scabini bendati. Spunti storici e prospettive per una deontologia dei magistrati nell’epoca attuale

Resumen

Ogni epoca ha avuto il suo giudice: il giudice santo e forte nel medioevo, il giudice prudente nell’età moderna e il giudice “bouche de la lois” nell’età delle codificazioni. Oggi prevale ancora quest’ultima impostazione che non conosce altra deontologia che quella stabilita dalla legge o racchiusa in “codici” approvati dagli stessi magistrati. Il saggio indaga sulle antiche regole
deontologiche connesse ai modelli di giudice delle diverse epoche e propone una loro riconsiderazione nell’attualità.

Every age had its own kind of judge: firstly the medieval saint and strong judge, then the modern oge prudent judge and finally the age of codification “bouche de la lois” judge. Nowadays it is the latter ideal image of the judge which still prevails – an image that does not know any other different deontology from the one established by the law or contained in “codes” approved by the judges themselves. This essay is intended to examine the judge’s ancient deontological rules accordingly to the analysed era and to propose a reconsideration of them during the current age.
